1) Scope of Service

We provide roll-off rentals, including delivery, swaps (if offered/available), pickup, hauling, and disposal.

Service is subject to equipment limitations, disposal site policies, weather, site access, safety conditions, and scheduling capacity.

2) Definitions

  • Residential Rental: Bundled flat-rate pricing with included tonnage by size.
  • Clean Fill Rental: Inert material only, as described below.
  • Scale Ticket: Weight receipt from the disposal facility (landfill/transfer station).
  • Rental Period: Calendar days from delivery to pickup.
  • Trip Charge / Dry Run: A charge for a delivery or pickup attempt that cannot be completed due to site access, obstructions, or unsafe conditions beyond our control.
  • C&D: Construction & Demolition debris (mixed building material waste), priced by weight at our standard rate schedule.

3) Acceptance, Authority, and Incorporation Into Order

  • You represent that you have authority to place the order and accept these Terms for yourself and/or the property owner.
  • These Terms are incorporated into your order and apply to all services provided in connection with your rental.

4) Pricing Models, What’s Included, and Proof

4.1 Residential Rentals (Bundled Flat-Rate)

  • Residential rentals are quoted as a bundled flat-rate that includes delivery, the standard rental period, pickup/haul, and disposal up to the included tonnage shown on our Pricing page. Included tonnage varies by dumpster size.
  • If the actual scale weight exceeds the included tonnage, overage is billed at $79 per ton for weight above the included amount and is based on the disposal facility scale ticket.

4.2 Trade / Contractor Rentals (By-Weight)

  • Trade/contractor rentals are billed as base rate + disposal by weight, as shown on our Pricing page. The standard rental period for trade/contractor orders is listed on the Pricing page and/or your order confirmation.
  • Disposal is billed based on the disposal facility scale ticket at $79 per ton, with a 1-ton minimum billed disposal per haul (loads under 1 ton are billed as 1 ton).
  • Right Size Guarantee does not apply to trade/contractor pricing.

4.3 Clean Fill Rentals (Inert Only)

  • Clean fill rentals are for inert materials only (such as dirt, concrete, asphalt, brick, and similar inert material), as described on our Materials/Rules pages and Pricing page.
  • Contamination rule: If trash, mixed debris, or non-inert materials are present, the entire load will be treated as Construction & Demolition (C&D) and billed by weight at $79 per ton based on the scale ticket.

4.4 Proof for Every Load

  • We document loads with pickup photos and the disposal facility scale ticket to support fair, transparent billing. Scale ticket timing/availability depends on the disposal facility.
  • Photos are taken at pickup; scale tickets are issued by the facility and may be delayed.

4.5 Pricing Source of Truth

  • Current base rates, included tonnage, and size-specific pricing are posted on our Pricing page. Your order confirmation and/or final invoice controls the price and terms for your specific rental. Materials, loading rules, and prohibited items are further described on our Materials/Rules pages, which are incorporated into these Terms by reference.

5) Rental Period and Additional Days

Unless otherwise stated in writing:

  • Residential: 1–7 days included
  • Trade/Contractor: 14 days standard
  • Clean Fill: 7 days maximum
  • Additional days: Days beyond the included/standard period are billed at $21.29 per day.
  • Pickup is not automatic unless scheduled. You (or your project lead) must request pickup when ready. Additional day charges continue to accrue until the dumpster is picked up.
  • Rental days are counted in calendar days, including weekends and holidays, beginning on the calendar day of delivery and continuing through the calendar day the dumpster is picked up.

6) Right Size Guarantee (Residential Only)

  • Right Size Guarantee applies only to residential bundled flat-rate rentals and only to residential 20-yard orders.
  • If the 20-yard dumpster is half full or less by volume AND the scale ticket shows ≤ 1 ton, we credit the rental to 15-yard pricing. Photo and scale ticket proof apply. Weight is the final call.
  • If either the volume or the weight condition is not met, the Right Size Guarantee does not apply and 20‑yard pricing remains in effect.

7) Driveway Protection and Property Conditions

  • We include driveway protection at no charge using Extreme-duty protection pads (RolliSkates) on every delivery. Pads reduce risk but do not eliminate it.
  • You are responsible for site conditions. Soft ground, heat-softened asphalt, steep grades, buried utilities, decorative surfaces, and poor access increase risk of damage. We may refuse placement where conditions appear unsafe or likely to cause damage.

8) Placement, Access, and Permits

8.1 Placement

  • You are responsible for selecting a safe, legal placement location and confirming the dumpster will not block access, sight lines, mailboxes, hydrants, utilities, or required lanes. We will place the dumpster where directed if we determine access is safe and the surface appears suitable. Final placement may be adjusted at the driver’s discretion for safety and equipment limitations.

If you need a specific placement, please mark the spot (cones/chalk) or text us a photo of the intended location before delivery.

8.2 Access and Inaccessible Service

  • You must provide safe access for delivery and pickup, including adequate clearance, stable ground, and an unobstructed path. If we cannot complete delivery or pickup due to blocked access (vehicles, locked gates, snow/ice, soft ground, low wires/branches, steep grades, or other obstructions), we may reschedule.
  • If a delivery or pickup attempt is made but cannot be completed, a Trip Charge (“Dry Run”) may apply. Additional day charges continue to accrue while access prevents pickup.

8.3 LFUCG Street Permits and HOA/POA

  • Street / Right-of-Way Placement (LFUCG Lane Blockage / Street Use Permit — Lexington/Fayette County):
If the dumpster must be placed on a Lexington street or public right-of-way, an LFUCG Lane Blockage / Street Use Permit is required (see official LFUCG details).

Per LFUCG (as of v2026.02), this permit is free ($0) but mandatory when blocking any portion of a street in Fayette County.

We can obtain the permit on your behalf; processing typically takes 1–3 business days. HOA/POA approvals remain the customer’s responsibility.

9) Prohibited Materials and Compliance

  • You may not place hazardous or prohibited materials in the dumpster, including (not exhaustive): chemicals, asbestos, flammables, medical waste, and radioactive materials.
  • If prohibited materials are discovered, you are responsible for all resulting costs, including surcharges, remediation, refusal fees, returns, or special handling charges.
  • Prohibited materials also include any items the disposal facility refuses or surcharges (for example: tires, appliances with refrigerant, large batteries, electronics, and liquids), and any other materials listed as prohibited on our Materials/Rules pages or by the disposal facility.

10) Loading Rules, Weight, and Safe Transport

  • Do not fill above the top rim.
  • Do not overload beyond 15 tons.
  • Contents must be safe for transport and compliant with applicable laws.
  • If a dumpster is overloaded or unsafe to haul, we may require you to remove material before pickup. Delays caused by unsafe loading may result in additional day charges and/or additional trip charges if a second visit is required.
  • No relocation: You may not move or relocate the dumpster without our authorization.

11) Payment Terms, Charge Authorization, and Late Fees

  • Payment is due prior to or upon delivery, unless you are an approved trade account with Net 15 terms.
  • Net 15: Net 15 applies to approved trade accounts only. Net 15 late fee: 2% per month.
  • Charge authorization: Amounts due may be charged to the payment method on file, including additional day fees, overage, contamination charges, trip charges, or other charges incurred under these Terms.
  • Trip Charges (Dry Runs) are $90 within our core service area (Lexington, Georgetown, Nicholasville). For locations outside the core area, the Trip Charge increases based on distance. The applicable Trip Charge will be disclosed at booking or shown on the invoice.
  • You authorize us to process additional charges (including overage, contamination, additional days, and trip charges) to the payment method on file after final disposal information and charges are received from the disposal facility.

12) Taxes and Fees

  • Kentucky waste hauling is tax-exempt. No sales tax. No processing fees. Disposal and overage charges are based on applicable rate schedules and the scale ticket.

13) Damage, Loss, and Customer Responsibility

  • You are responsible for loss, theft, fire, graffiti, or damage beyond normal wear during the rental period, including damage caused by ground conditions, subsurface conditions, or placement locations you request or approve, except to the extent damage is caused solely by our driver’s failure to follow your placement directions or by our willful misconduct.
  • You are responsible for keeping the dumpster accessible for pickup and protecting it from being blocked, locked in, or otherwise inaccessible.

14) Indemnification

  • You agree to indemnify, defend, and hold harmless Rubble Jockey LLC and its members, managers, employees, and agents from all claims, damages, fines, penalties, liabilities, and expenses (including reasonable attorney fees) arising out of or related to:
  • (a) the materials you or others place in the dumpster,
  • (b) the placement location and site conditions,
  • (c) loading, use, or access to the dumpster, or
  • (d) your breach of these Terms.

15) Limitation of Liability

To the maximum extent permitted by law, Rubble Jockey LLC is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the amount paid to us for the rental giving rise to the claim, except to the extent such limitation is prohibited by applicable law (for example, in cases of willful misconduct or where personal injury is caused solely by our gross negligence).

16) Refusal of Service and Termination

  • We may refuse or terminate service and remove the dumpster for nonpayment, prohibited materials, unsafe conditions, unlawful use, or breach of these Terms.
  • If service is refused or terminated for these reasons, you remain responsible for all fees incurred to that point, including trip charges, additional days, and any costs to remove or remediate prohibited materials.

17) Electronic Communications and Records

You consent to receive communications electronically (text/email), including scheduling notices, invoices, scale tickets, and payment communications. Electronic records and timestamps may be used to confirm delivery, pickup, and billing.

18) Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including severe weather, road closures, disposal site disruptions, equipment failure, or governmental actions.

19) Severability, No Waiver, Assignment

If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver. You may not assign your rights or obligations without our consent.

20) Entire Agreement and Order of Priority

These Terms & Conditions, together with any written order confirmation, invoice, approved trade account terms (if applicable), and the Rubble Jockey Dumpster Rental Agreement (Compact) referenced at checkout or provided with the order (collectively, the “Agreement”), constitute the entire agreement between the parties and supersede prior discussions or understandings.

Order of priority (to resolve conflicts):

  1. Order confirmation and/or invoice controls the job-specific details for your rental, including pricing, included tonnage (if applicable), rental period, delivery/pickup dates, location, selected size, and any quoted or disclosed fees.

  2. These Terms & Conditions control all other terms governing the rental and services.

  3. Approved trade account terms (if applicable) apply only to the extent they do not conflict with the order confirmation/invoice or these Terms.

  4. The Dumpster Rental Agreement (Compact) is a summary/convenience document and does not override the items above.

No modification or waiver is valid unless made in writing by Rubble Jockey LLC.

21) Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Kentucky. Venue and jurisdiction shall be in the appropriate Kentucky courts.

22) Dispute Resolution and Attorney Fees

The parties will attempt in good faith to resolve any dispute informally within 30 days of written notice before filing suit, except for claims seeking emergency injunctive relief or collection of undisputed amounts.
